Terms of Use for the Media Archive (Phraseanet)

1. Scope

These Terms of Use govern access to and use of the digital media archive (Phraseanet) by registered users.

By using the system, the user agrees to these terms.

2. Purpose of the Archive

The archive is intended for storing, managing, and providing digital media (e.g. images, documents, audio, and video files) in the context of the organization’s activities.

Any use beyond this purpose is not permitted.

3. Access Authorization

  • Access is restricted to registered and authorized users.
  • Login credentials must be kept confidential and must not be shared.
  • The operator reserves the right to suspend or delete user accounts at any time.

4. Uploading Content

Users may only upload content if:

  • they hold the necessary rights (copyright, usage rights),
  • no third-party rights are violated,
  • the content is not unlawful.

In particular, the following is prohibited:

  • copyrighted material without permission
  • personal data without legal basis
  • offensive, discriminatory, or illegal content

5. Rights to Content

  • Uploaded content remains the property of the respective rights holder.
  • By uploading content, the user grants the operator a non-exclusive right to store, manage, and make the content available within the archive.
  • Other users may only use content within the scope of the specified rights.

6. Personal Data

  • Personal data may only be uploaded if there is a valid legal basis (e.g. consent).
  • Users are responsible for complying with applicable data protection laws.

7. Deletion of Content

The operator may remove content without prior notice if:

  • it violates these terms
  • legal risks arise
  • it is no longer needed

There is no entitlement to permanent storage.

8. Availability

  • The operator does not guarantee uninterrupted availability of the system.
  • Maintenance, outages, or technical issues may occur at any time.

9. Liability

  • The operator is not liable for data loss unless caused by intentional or grossly negligent behavior.
  • Users are responsible for backing up their own data.

10. Termination of Use

  • The operator may revoke access at any time.
  • Upon termination, content may be deleted or archived.

11. Changes to the Terms

The operator reserves the right to modify these terms at any time. Continued use constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of the Federal Republic of Germany.
